Terms of Service

These Terms govern the use of the InfluenciMax platform (website, app, and services). By creating an account, subscribing to a plan, or using any feature, you agree to these Terms.

Important reading: these Terms include rules about account, payment, acceptable use, intellectual property rights, limitations of liability, and how to resolve disputes.

1. Acceptance and definitions

By accessing or using InfluenciMax, you declare that you have read and agree to these Terms. If you are using it on behalf of a company, you declare you have authority to bind it to these Terms.

  • “Platform/Services”: website, app, and features (including automations, reports, and integrations).
  • “User”: individual or legal entity that uses the platform.
  • “User Content”: texts, messages, settings, flows, and materials sent or generated by the User.

2. Eligibility and registration

You must provide true, current, and complete information at registration and keep it updated. Use by minors must follow the rules of item 15 (use and responsibility) and applicable law.

3. Account, password, and security

  • You are responsible for keeping your password confidential and for all activity on your account.
  • Notify us immediately if you suspect unauthorized access.
  • We may require additional verifications to protect your account.

4. Plans, trials, and subscriptions

InfluenciMax may offer free plans, trials, and paid plans with different limits and features. Characteristics and prices may vary and will be shown on the plans page and/or at checkout.

Resources and limits may depend on the plan (e.g., number of automations, tracking, integrations).

5. Payments, renewal, and refunds

  • Renewal: subscriptions may renew automatically unless canceled before the next cycle.
  • Payment failure: we may suspend paid-plan features until regularization.
  • Refunds: follow the policy shown at checkout and the Consumer Protection Code when applicable.
Charges may be processed by payment providers (third parties), subject to their own terms.

6. Acceptable use and prohibitions

You agree not to use the platform to:

  • Violate laws, third-party rights, or rules of integrated platforms.
  • Send malware, exploit vulnerabilities, reverse engineer, or try to bypass security.
  • Engage in spam, fraud, harassment, hate speech, or illegal activities.
  • Use InfluenciMax in ways that harm service stability (request abuse).

7. User content and responsibility

You are solely responsible for the content, messages, flows, and settings you create and send, as well as for obtaining any necessary authorizations (e.g., consents, image rights, legal bases).

We may remove, restrict, or block content/settings that violate these Terms or the law.

8. Integrations and third-party services

InfluenciMax may integrate with third-party platforms and services. These third parties have their own terms, policies, and limits. We do not control or are responsible for downtime, API changes, or decisions by those platforms.

9. AI and automations

Some features may use AI to suggest texts/replies. AI can fail, “hallucinate,” or generate inappropriate responses. You are responsible for reviewing, adjusting, and validating responses/flows before activating in production.

  • You should not enter sensitive data without need.
  • You should set safeguards (e.g., blocked words, escalation to human) when applicable.

10. Intellectual property

InfluenciMax (brand, layout, code, texts, documentation, and technology) is protected by intellectual property rights. You receive a limited, revocable, non-exclusive license to use the platform under these Terms.

11. Availability, support, and maintenance

We aim to maintain high availability, but interruptions may occur due to maintenance, updates, third-party failures, or events beyond our control. We may change features to evolve the product and ensure security.

12. Suspension and termination

We may suspend or terminate your account if there is a violation of these Terms, suspected fraud, security risk, legal order, or use that harms the platform. You may close your account according to your plan rules.

13. Privacy and data protection

The processing of personal data is governed by our Privacy and Security Policy and by applicable law, including the LGPD. By using the platform, you confirm that you have read and understood this policy.

Tip: keep your data up to date and avoid entering sensitive data when not necessary.

14. Information security

We adopt reasonable security measures (access controls, logs, backups, and continuous improvements). Still, no system is 100% immune. You should also protect your account and devices.

15. Disclaimers and limitations

  • The service is provided “as is” and may undergo changes and improvements.
  • We do not guarantee specific results (e.g., sales, leads, performance), as they depend on multiple external factors.
  • To the extent permitted by law, we limit liability for indirect damages, lost profits, and losses caused by third parties.
Nothing here limits non-derogable consumer rights when applicable (Consumer Protection Code).

16. Indemnification

You agree to indemnify InfluenciMax for third-party claims arising from your use of the platform, your User Content, or violation of these Terms, to the extent permitted by law.

17. Communications and notifications

We may send communications about your account (security, support, billing, important changes). You can adjust preferences when available, while keeping essential communications.

18. Changes to the Terms

We may update these Terms to reflect legal, product, or security changes. If there are relevant changes, we may notify on the site or by email. Continued use after the update indicates acceptance.

19. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. When applicable, the Consumer Protection Code and data protection legislation are respected.

The venue of the consumer's domicile is elected when applicable. In other cases, the parties elect the venue of the district of São Paulo/SP, unless legally required otherwise.
